Governor — Role, Discretionary Powers & Politicisation

To preserve the federal spirit of 'Cooperative Federalism,' the Governor's office must transition from being a 'political watchdog' to a 'constitutional sentinel.' Adhering to the recommendations of the Sarkaria and Punchhi Commissions is essential to restore the sanctity of this office.

The Governor is a constitutional functionary under Articles 153 to 167, acting as the formal head of the State Executive. Positioned at the intersection of the Union and the States, the office holds a dual role: the constitutional head of the state and a vital link between the Centre and the State, which often places the office at the heart of federal tensions.

Agent_of_centre: The Governor is appointed by the President, which often leads to the perception of the office being an instrument of the Union government to influence state politics and maintain central hegemony.

Constitutional_head: As the nominal executive, the Governor exercises powers on the aid and advice of the Council of Ministers (CoM) headed by the Chief Minister, ensuring the state administration follows constitutional norms.

Situational_discretion: Arises during political instability, such as: 1. Appointment of CM when no party has a clear majority. 2. Dismissal of the CoM if it loses the confidence of the House but refuses to resign. 3. Dissolution of the Legislative Assembly if the CoM has lost its majority.

Constitutional_discretion: Unlike the President, the Governor has explicit constitutional discretion under Article 163. Key areas include: 1. Reservation of a Bill for the President's consideration (Art 200). 2. Recommendation for President's Rule (Art 356). 3. Seeking information from the CM regarding administrative/legislative affairs (Art 167).

Misuse_of_art_356: Frequent imposition of President's Rule to dismiss state governments led by opposition parties, a practice curtailed by the S.R. Bommai judgment.

Partisan_appointments: The tendency of the Centre to appoint 'politically aligned' individuals, undermining the neutrality expected of the office.

Role_in_hung_assemblies: Subjective use of discretion in inviting leaders to form governments, often favoring the ruling party at the Centre.

Bill_reservation_impasse: Delaying assent to state bills indefinitely (the 'pocket veto' phenomenon) or reserving bills solely to stall state legislation, creating a legislative deadlock.

Punchhi_commission: Suggested a fixed tenure for Governors and a mechanism for their removal similar to impeachment to ensure independence from the pleasure of the President/Centre.

Sarkaria_commission: Recommended that the Governor should be an eminent person from outside the state, not intimately connected with local politics, and should be appointed in consultation with the Chief Minister.
