Centre-State Administrative Relations

The transition from 'Confrontational Federalism' to 'Cooperative and Competitive Federalism' is essential. Strengthening institutional mechanisms like the Inter-State Council and ensuring the neutrality of the Governor's office will help balance administrative efficiency with regional autonomy.

Administrative relations between the Centre and the States are governed by Part XI (Articles 256 to 263) of the Indian Constitution. While India follows a federal structure, the administrative framework is characterized by a 'unitary tilt,' designed to ensure national integrity and uniform implementation of developmental goals. The essence of these relations lies in the balance between state autonomy and central oversight.

Use_of_directions: Frequent use of Article 256/257 to issue directions can be perceived as 'command federalism,' limiting the discretionary powers of state executives.

Role_of_the_governor: The Governor, appointed by the President, often acts as a friction point. Allegations of being an 'agent of the Centre' arise when Governors delay assent to bills or recommend President's Rule (Art 356) based on perceived constitutional breakdowns.

Central_agencies_and_investigations: The increasing involvement of central agencies like the CBI, ED, and NIA in state jurisdictions often leads to accusations of overstepping, where states claim their autonomy in law and order (a State subject) is being undermined.

All_india_services: Under Article 312, the creation of All India Services (IAS, IPS, IFoS) serves as a bridge. While these officers serve the States, they are recruited and trained by the Centre, ensuring a unified administrative standard and providing the Centre with a mechanism to maintain national standards in state administration.

Delegation_of_functions: Article 258 empowers the President to entrust Union executive functions to a State government (with consent), while Article 258A allows a State Governor to entrust State functions to the Union (with Union consent). This provides flexibility in administration during exigencies.

Compliance_and_directions: Article 256 mandates that the executive power of every State shall be exercised to ensure compliance with the laws made by Parliament. Article 257 allows the Union to issue directions to States to ensure that the executive power of the State does not impede the Union's executive power, particularly regarding means of communication of national importance.

Inter_state_council: Established under Article 263, it serves as a platform for discussing and investigating subjects of common interest between the Union and States, promoting 'Cooperative Federalism.'

Inter_state_water_disputes: Article 262 allows Parliament to provide for the adjudication of disputes regarding inter-state river waters, bypassing traditional judicial routes to ensure specialized administrative handling.

Punchhi_commission: Recommended a fixed tenure for Governors and emphasized the need for 'Cooperative Federalism' through effective use of the Inter-State Council.

Sarkaria_commission: Emphasized that the Centre should only use Art 356 as a last resort and that the Governor should be a person not intimately involved in local politics.
